Welcome to 9 to 5 Vintage. These Terms & Conditions apply to the use of our website and to all purchases made through our online store.

By visiting our website or placing an order, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

Throughout these Terms, “we”, “us” and “our” refer to 9 to 5 Vintage B.V.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products to you.

2. OUR PRODUCTS

9 to 5 Vintage sells carefully selected pre-owned and vintage clothing and accessories.

Because our pieces are pre-owned, they may show signs of previous wear, age or use. These characteristics are part of the nature of vintage and second-hand items and are not considered defects.

We do our best to accurately photograph and describe every item, including any significant signs of wear, damage or imperfections known to us.

Please review all product photographs, descriptions, measurements and condition information carefully before placing an order.

Colours may appear slightly different depending on your screen, device and display settings.

Many of our pieces are unique and available only once. Adding an item to your shopping cart does not reserve it. An item is only secured once your order has been successfully completed.

3. SIZING & MEASUREMENTS

Vintage and pre-owned sizing can differ considerably from modern sizing.

Where possible, we provide measurements and/or our estimated modern size in the product description.

Customers are responsible for checking the measurements provided before purchasing. If you are unsure about the size or fit of an item, please contact us before ordering.

4. ORDERS

By placing an order, you are making an offer to purchase the selected product(s).

After placing your order, you will receive an order confirmation by email.

We reserve the right to refuse or cancel an order in exceptional circumstances, for example if an item is unexpectedly unavailable, an obvious pricing error has occurred or we reasonably suspect fraudulent activity.

If we cancel an order after payment has been received, the relevant amount will be refunded.

5. PRICES & PAYMENT

All prices displayed on our website are shown in the currency indicated during checkout.

Where applicable, taxes are included or applied in accordance with applicable law.

Shipping costs are calculated separately during checkout unless explicitly stated otherwise.

For deliveries outside the European Union, additional import duties, taxes or customs charges may apply. Unless otherwise required by law, these charges are the responsibility of the customer and are not included in our product or shipping prices.

Available payment methods are displayed during checkout.

6. SHIPPING & DELIVERY

Orders are shipped from the Netherlands.

Shipping costs and estimated delivery times are displayed during checkout and/or explained in our Shipping Policy.

Once your order has been dispatched, you will receive tracking information where available.

Delivery times are estimates. Delays caused by shipping carriers, customs procedures or circumstances outside our reasonable control may occur.

Nothing in these Terms limits any rights you may have under applicable consumer law if an order is not delivered within a legally required or agreed period.

7. RETURNS

All vintage sales are final, except if an item significantly differs from its description or has a major undisclosed flaw or is from 9 to 5 vintage's own collection.

For EU consumers, this will generally be 14 days after receiving the order, subject to applicable exceptions.

After notifying us, the item must be returned within the legally applicable return period.

Returned items must be handled with reasonable care and returned with any original tags or labels still attached where applicable. You may inspect an item as you reasonably would in a physical store, but you may be responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the item.

Return shipping costs are the responsibility of the customer.

8. VINTAGE CONDITION & IMPERFECTIONS

Please remember that you are purchasing pre-owned items.

Normal signs of age and previous wear can be expected. We consider this part of the character of vintage clothing.

We aim to disclose significant imperfections that we identify before listing an item. However, minor signs of wear consistent with the item’s age and second-hand nature may be present.

9. DAMAGED OR INCORRECT ITEMS

If you believe you have received an incorrect item or an item that materially differs from its description, please contact us at hello@9to5vintage.com as soon as reasonably possible.

Please include your order number and, where helpful, photographs showing the issue.

We will review the situation and provide an appropriate solution in accordance with applicable consumer law.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the content created for this website—including our branding, logo, photographs, graphics, text and original website content—is owned by or licensed to 9 to 5 Vintage B.V.

This content may not be copied, reproduced, distributed, republished or commercially used without our prior written permission, except where permitted by law.

Third-party brand names and trademarks appearing in connection with vintage products remain the property of their respective owners.

9 to 5 Vintage is an independent vintage retailer and is not affiliated with, endorsed by or sponsored by the original brands of the pre-owned items we sell unless explicitly stated otherwise.

11. THIRD-PARTY SERVICES

Our website may use or link to services provided by third parties, including payment providers, delivery companies, social media platforms and Shopify.

Your use of certain third-party services may also be subject to their own terms and privacy policies.

We are not responsible for third-party websites or services to the extent permitted by applicable law.

12. PRIVACY

We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR where applicable.

Our Privacy Policy explains what information we collect, why we collect it and how it may be used.

13. WEBSITE AVAILABILITY

We aim to keep our website and online store accurate and available, but we cannot guarantee that the website will always operate without interruptions or technical errors.

We may update, modify or temporarily suspend parts of the website when reasonably necessary.

Obvious typographical, technical or pricing errors may be corrected.

14. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the extent permitted by law, 9 to 5 Vintage B.V. is not responsible for indirect losses that were not reasonably foreseeable when the purchase agreement was entered into.

Your mandatory statutory consumer rights remain unaffected.

15. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time, for example when our services change or when required by applicable laws or regulations.

The version applicable to your purchase is generally the version in effect when your order is placed, unless mandatory law provides otherwise.

The latest version will be available on our website.

16. GOVERNING LAW

These Terms & Conditions and agreements with 9 to 5 Vintage B.V. are governed by Dutch law.

If you are a consumer living in another EU country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law of your country of residence.

Any disputes will be handled by the competent court in accordance with applicable law.
